Defendants raised the topics of the offense, mitigation, future behaviour and the sentence in different ways and this book explores the pros and cons associated with the different strategies that they used. Based on corpus data, Gruber argues that the application of Austin’s (1962) performative–constative continuum reveals that offense-related utterances that fall closer to the constative end are.. This paper reports the first case in which a linguist served as an expert witness in Hong Kong, a former British colony that has operated as a special administrative region of the People’s Republic of China (PRC) since 1997. The dispute was on the meaning of the political slogan “Liberate Hong Kong, Revolution of Our Times”, which was widely adopted during the 2019–2020 protests. The keywords “liberate” and “revolution” are smoking gun evidence for the prosecution in a large cluster of (...) cases that involve sedition law and national security offences. Section I of the paper provides background information about a case the author was involved in, which was concerned with whether the slogan was seditious. Section II describes the analysis conducted, which concludes that the slogan as a whole refers to a need to rectify a problem and to return to the original, a more desirable state of affairs for Hong Kong, without specifying what problem there is and what the desirable state of affairs looks like. Section III highlights some critical issues in the analysis, discussing challenges faced and ethical questions for the expert witness. This paper takes a bottom-up approach to empirically investigate how people construct the meaning of obscenity, and offers an experientialist, cognitive linguistic account to explain why the term appears to defy definition and makes a problematic legal concept. To study the contextual dependence of the term, we examined the extent to which various item characteristics (such as genre, context, and the race or celebrity status of the people portrayed) and individual variables (such as gender, religion, sexual orientation and previous personal (...) and cultural experiences) influence our perception of seemingly obscene materials. We report correlations that have not been previously shown. The data support the thesis that the meaning of obscenity emerges in a cognitive-affective response that arises during a dynamic process of interpretation, and thus allows for extralegal factors to influence judgment. The results challenge the assumption that obscenity is a symbolic representation of objectively existing reality and argue that community standard of obscenity is a legal fiction. (shrink)

One less obvious impact of legal bilingualism in a postcolonial jurisdiction like Hong Kong is an increasing trend of unrepresented litigants. Since their lack of legal knowledge often places them at a disadvantage and poses numerous problems in court, the government has established the resource centre for unrepresented litigants to offer them information about legal procedure. This paper evaluates the usefulness of the Chinese official reference materials at the centre in equipping laymen for civil litigation. As a first point of (...) contact between unrepresented litigants and the law, these leaflets have a direct impact on the users’ understanding of litigation procedures and their courtroom performance. This paper argues that the leaflets suffer from two major problems: incomprehensibility of language and lack of structure. Problems involved in include inconsistency in terminology, problematic translation, and language complexity arising from the use of odd collocation, unusual words, difficult legal terminology and confusing parts of speech; whereas in , information is found to be scattered and disorganised. To improve readability, the paper suggests using plain language, and providing checklists of documents, and a legal glossary. Cross-jurisdiction practices will be examined to show how unrepresented litigants’ access to justice may be facilitated. (shrink)

We show that for finite n⩾3n⩾3, every first-order axiomatisation of the varieties of representable n-dimensional cylindric algebras, diagonal-free cylindric algebras, polyadic algebras, and polyadic equality algebras contains an infinite number of non-canonical formulas. We also show that the class of structures for each of these varieties is non-elementary. The proofs employ algebras derived from random graphs.

This essay attempts to approach the dispute over the conceptualist or non-conceptualist interpretation of Husserl’s conception of intentional experience from a specific question: Is the intuitive act essentially a carrier of meaning? In the sixth Investigation, Husserl apparently tries to show that intuition is no carrier of meaning and therefore must be unified with a meaning-conferring act in order to be meaningful. But it seems to me that the brief arguments given by Husserl here are far from conclusive and that (...) there are passages in the Logical Investigations which suggest otherwise. I will try to demonstrate that the sense conferred by the interpretation in perception is not different from linguistic meaning, and therefore perception is actually a synthetic act of fulfillment and is always meaningful. The conceptualist reading is no less convincing and no less susceptible to objections than the non-conceptualist one. (shrink)

Kants Kritik der transzendenten Metaphysik in der transzendentalen Dialektik der Kritik der reinen Vernunft war durchschlagend und findet auch in der Philosophie der Gegenwart breite Zustimmung. Weniger Zustimmung und Verständnis findet die systematische Konzeption der transzendentalen Dialektik, die Lehre vom Bezug der Vernunft auf das Unbedingte als notwendigem, unvermeidlichem Schein. Die vorliegende Studie untersucht diese Konzeption. Sie stellt die in der Forschung weitgehend ungeklärten Fragen (a) nach der Notwendigkeit des Scheins und dem logischen Status der Schlüsse der Vernunft auf das (...) Unbedingte, insbesondere nach der logischen Struktur der Antinomien, (b) nach dem Zusammenhang zwischen den Lehrstücken der Dialektik (von den Ideen der Vernunft als Begriffen vom Unbedingten, von den dialektischen Schlüssen, vom angemessenen Gebrauch der Ideen), (c) nach dem systematischen Verhältnis von Analytik und Dialektik als den beiden Teilen der transzendentalen Logik und nach der Funktion der Dialektik im architektonischen Zusammenhang der Kritik. Es ist die These der Studie, dass die Dialektik die Grundlage der kritischen Philosophie darstellt und dass ihre negative und ihre positive Lehre von der Vernunft unzertrennlich zusammenhängen. Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. This Special Issue on “Polymedia in interaction” theorizes and empirically investigates practices and ideologies of digitally mediated interaction under conditions of polymedia. We argue that the proliferation of mobile interpersonal communication in the 2010s calls for, and is reflected in, conceptual and methodological shifts in empirical research on digital language and communication in pragmatics and sociocultural linguistics. In this introduction, these shifts are crystallized in five interrelated themes: a turn from ‘computer-mediated communication’ to ‘digitally mediated interaction’ as a bracket category; (...) a move beyond the on/offline divide and focus on the integration of mediated interaction in everyday communication in micro-units of social structure ; an empirical downscaling towards private and small-scale public data; a shift from the study of single modes of digital communication to polymedia; and a focus on semiotic repertoires and registers of digital mediation. Research that orients to these focal points is compared with other trends in digital language research, including computational methods. The papers in this issue flesh out these five dimensions with findings from qualitative research, based on multi-sited linguistic and digital ethnographies in various sociolinguistic settings. In this paper we investigate nonnormal modal systems in the vicinity of the Lewis system S1. It might be claimed that Lewis's modal systems (S1, S2, S3, S4, and S5) are the starting point of modern modal logics. However, our interests in the Lewis systems and their relatives are not (merely) historical. They possess certain syntactical features and their frames certain structural properties that are of interest to us. Our starting point is not S1, but a weaker logic S1 (S1 (...) without the schema [T]). We extend it to S1D, which can be considered as a deontic counterpart of the alethic S1. Soundness and completeness of these systems are then demonstrated within a prenormal idiom. We conclude with some philosophical remarks on the interpretation of our deontic logic. (shrink)

In recent decades, the phenomenon of grief, when you lose a loved one, has been the subject of exploration and discussion among researchers. Because of this, prolonged grief is now recognized as a possible mental disorder as the latest version of the diagnosis manual; ‘International Classification of Diseases’ (ICD‐11) being published in 2018 is featuring a new diagnosis called ‘prolonged grief disorder’. The commencement of this new disorder indicates a shift in the way grief is being articulated why the notion (...) of rupture from the French philosopher Michel Foucault is applied as a philosophical approach in this paper. A Foucault‐inspired discourse analysis has been prepared and by considering the issue historically and tracing how the concept of grief has been articulated in different time periods throughout history, the aim is to map out the discursive transformation that has taken place and to gain insight into how the societal context has supported and enabled this transformation. This paper takes a historical look back from the 1800s to present and identifies when changes can be observed in the way grief is being articulated. These changes or ruptures are identified in the work of Søren Aabye Kierkegaard, Sigmund Freud and Margaret Stroebe & Henk Schut who all must be assumed to have contributed significantly to how grief is perceived in various historical time periods. The discourse analysis identifies how prominent thinkers have articulated grief in each period and how today's perception of grief, as a possible mental disorder, both relates to these prominent thinkers but also reflects dominant societal values and ideologies. This article explores the ethics of migrant marketers in Guangzhou. Data were collected from 357 migrant marketers who lived in Guangzhou. A model of Ethical Action has been developed to test the antecedents and outcomes of the ethical decision-making process. It measured moral intention using four ethical scenarios. The results show that the egoistic schema had a positive effect on their intention to act unethically, while the legislative schema exerted a negative effect. The results confirm that moral intention was a (...) strong predictor of an individual's subsequent actual behavior, and it fully mediated the influence of the legislative schema on actual behavior. This study adds to ethics literature by incorporating the construct of social identity and found a moderating effect between the legislative schema and moral intention. The relationships were stronger for individuals who were lower rather than higher in social identity. Analysis of these results lead to a discussion of the implications for marketing ethics in China. In Heidegger’s Black Notebooks some ideas about political embodiment can be found, which have come under suspicion to justify the Third Reich’s race law. In the following article, the analysis and discussion of Heidegger’s political embodiment will firstly be traced back to the traditional understanding of the human as a “rational animal”, and will then look at how the “racial being” is subsequently developed and eventually transformed into political absolute subjectivism. Moreover, Heidegger’s in-depth explanation and critique on Nietzsche’s metaphysics, which (...) he views as having transformed human experiences to a metaphysical representation and thus misunderstanding human nature, will also be clarified. Through Heidegger’s critic on biologism, a profound disclosure which potentially imply an attack of the racism at his time can be shown. Furthermore, Heidegger’s thinking of Being as a kind of emancipation of European political embodiment will also be analyzed. Lastly, although Heidegger and Confucianism have different ideas of lived-body, both schools basically show the same fundamental understanding of human nature. In regard to this, their understanding of political embodiment, their similarities and divergences, will be elucidated. (shrink)

An ontology of information belies our common intuitions about reality today and animates and governs both explicit scholarly study in philosophy and the sciences as well as the ideologies that are growing out of them. Transhumanism is one such technoscientific ideology that holds to a very specific ontology of information which need not be the only one on offer. This article argues that the transhumanist ontology of information exhibits gnostic and docetic religious overtones in it and that it devalues physical (...) existence. At the same time, despite claiming a rejection of supernature, hypothetical transhumanist practices (such as mind‐uploading) posit the infosphere as a kind of supernatural realm that is often set in opposition to the natural world. This article presents a critique of transhumanist conceptions of information and offers an alternative ontology of information that more adequately accounts for the distinction between the natural and supernatural as well as the integrity of the physical world. Obstetric ultrasound is the well-recognized prenatal test used to visualize and determine the condition of a pregnant woman and her fetus. Apart from the clinical application, some businesses have started promoting the use of fetal ultrasound machines for nonmedical reasons. Non-medical fetal ultrasound (also known as ‘keepsake’ ultrasound) is defined as using ultrasound to view, take a picture, or determine the sex of a fetus without a medical indication. Notwithstanding the guidelines and warnings regarding ultrasound safety issued by governments and (...) professional bodies, the absence of scientifically proven physical harm to fetuses from this procedure seems to provide these businesses with grounds for rapid expansion. However, this argument is too simplistic because current epidemiological evidence is not synchronous with advancing ultrasound technology. As non-medical fetal ultrasound has aroused very significant public attention, a thorough ethical analysis of this topic is essential. Using a multifaceted approach, we analyse the ethical perspective of non-medical fetal ultrasound in terms of the expectant mother, the fetus and health professionals. After applying four major theories of ethics and principles (the precautionary principle; theories of consequentialism and impartiality; duty-based theory; and rights-based theories), we conclude that obstetric ultrasound practice is ethically justifiable only if the indication for its use is based on medical evidence. Non-medical fetal ultrasound can be considered ethically unjustifiable. Nevertheless, the ethical analysis of this issue is time dependent owing to rapid advancements in ultrasound technology and the safety issue. The role of health professionals in ensuring that obstetric ultrasound is an ethically justifiable practice is also discussed. (shrink)

This paper attempts to investigate how and why organisations in Macao’s gambling industry engage in corporate social responsibility. It is based on an in-depth investigation of Macao’s gambling industry with 49 semi-structured interviews, conducted in 2011. We found that firms within the industry were emphasising pragmatic legitimacy based on both economic and non-economic contributions, in order to project positive images of the industry, while glossing over two domains of adverse externalities: problem gambling among visitors, and the pollution and despoliation of (...) the environment. By engaging symbolically rather than substantively in CSR, the gambling firms were diverting attention away from issues of moral legitimacy, in order to be allowed to continue to pursue “business as usual” as a means of obtaining substantial financial returns in a social, cultural and socio-political context that was exerting relatively little public pressure to improve corporate social and environmental performance. We conjecture that the gambling firms were feeding on borrowed time. (shrink)

This article examines the appearances of Augustus in Suetonius’ Lives of the Caesars outside Augustus' own Life. It shows how Suetonius contrasts the positive image of Augustus drawn in the Life of Augustus with the distortion of this image by Augustus’ successors, depicted in the later Lives. In their reception, he is still presented as an ideal to follow, yet as a role model for cruelty (Tiberius), adultery and military failure (Caligula), or lyre-playing (Nero)—roles which Suetonius’ real Augustus never or (...) only marginally assumed. Thus in a series of close and intratextual readings, this article invites a more general reassessment of Suetonius’ work: it suggests that the Lives of the Caesars draw a more critical image of the Principate than has often been said, that they are more consciously part of an image-making process and, above all, that they should more commonly be understood as one whole work, rather than read individually and in isolation. Die systematische Kritik Hegels am Empirismus zu erschließen bedeutet, den Empirismus als eine ›Musterform‹ einer Reihe von besonderen Positionen einzuordnen und ihn, als eine ›Stellung des Gedankens zur Objektivität‹, als strukturelles Problem und Moment der Philosophie des Absoluten zu bestimmen. Zum ersten Mal wird der Versuch unternommen, die Hegelsche Kritik am Empirismus aus seinem eigenen Werk zu rekonstruieren. Im Mittelpunkt steht die systematische Auseinandersetzung Hegels mit der neuzeitlichen empiristischen Philosophie in den ersten zwei Kapiteln der Phänomenologie des Geistes, worin die (...) Frage der sinnlichen Erfahrung und ihrer Analyse am intensivsten dargestellt und geprüft wird. Vom systematischen Standpunkt der Schrift her werden die im ganzen Werk Hegels verstreuten kritischen Stellen betrachtet und ausgelegt. (shrink)
